US Court Orders Release of Kilmar Abrego Garcia from ICE Detention

A federal judge has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, finding his continued confinement is without legal authority.

"Since his return from wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.

The situation originates in a mistaken deportation to El Salvador earlier this year, which the government later acknowledged was an mistake. Following his return to the United States to answer human smuggling allegations, he was held in immigration detention.

In her decision, the court noted that the government lacks a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."

Background of the Case

The legal challenge center on disputed claims. While the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this claim.

He has also pleaded not guilty to the smuggling charges, which are part of a separate trial in Tennessee.

Terms of Release

The court, who was overseeing his petition to deportation in a Maryland district court, determined that he must now adhere to the conditions of his release from custody in Tennessee. This order shifts his supervision to the Tennessee court.
